TERMS OF SERVICE |

TypicalHost's web hosting
service (the "SERVICE'), is provided to you (the
"USER") under the terms and conditions of this Terms of Service and any
amendments thereto and any operating rules or policies that may be published
from time to time by
TypicalHost. BY COMPLETING THE REGISTRATION PROCESS
AND CLICKING THE "I Agree" BUTTON BELOW, YOU ARE AGREEING TO BE BOUND BY THIS
TERMS OF SERVICE. The spirit of
this policy is to ensure our USERs are using
TypicalHost
services with due regard to the rights of other Internet users and in
conformity with the requirements of
TypicalHost
network environment. |

I. Illegal Use |
|
TypicalHost's
web hosting service may be used
for lawful purposes only. Transmission, storage, or distribution of any
information, data, or material in violation of any applicable law or
regulation is prohibited. This includes, but is not limited to: copyrighted
material; trademarks; trade secrets or other intellectual property rights
used without proper authorization; material that is obscene, defamatory,
constitutes an illegal threat, or violates export control laws. Examples of
unacceptable content or links include: pirated software, hacker programs or
archives, Warez sites, MP3, and IRC bots. |

II.
Modifications to SERVICE |
|
TypicalHost reserves the
right to modify or discontinue, temporarily or permanently, the SERVICE with
or without notice to USER. USER agrees that TypicalHost shall not be liable
to USER or any third-party for any modification or discontinuance of the
SERVICE. |
|
|
III. Security |
|
Violations of system or network security are
prohibited and may result in criminal and civil liability. Examples include
but are not limited to the following: unauthorized access, use, probing, or
scanning of systems security or authentication measures, data, or traffic;
interference with service to any user, host, or network including, without
limitation, mail bombing, flooding, deliberate attempts to overload a
system, broadcast attacks; forging of any TCP-IP packet header or any part
of the header information in an email or a newsgroup posting. |

IV. Adult Content |
|
Adult-oriented sites, pornography and
sex-related merchandising are prohibited. This includes sites that may infer
sexual content or provide links to adult content elsewhere. This is also
true for sites that promote any illegal activity or content that may be
damaging to our servers or any other server on the Internet, or provide
links to such sites. |

V. UCE (Unsolicited Commerce Email) - SPAM |
|
Spamming, the sending of
unsolicited mass email from or through a
TypicalHost server is STRICTLY
prohibited.
TypicalHost
will be the sole arbiter as to what constitutes a violation of this
provision. USERs are also in violation of this
provision if they engage in spamming using the service of another ISP or IPP,
but channel activities through a
TypicalHost server as a mail drop for
responses. Violators will face immediate suspension. |

VI. Service Abuse |
|
Any attempts to undermine
or cause harm to a
TypicalHost server or customer are strictly prohibited.
Any web hosting account deemed to be adversely affecting server performance
or network integrity will be shut down without prior notice. |
|
Any use of server resources that disrupts the normal use of
the services for others. Examples of system abuse include: chatroom
programs, consuming excessive amounts of CPU time or memory. |
|
|
VII.
Disclaimer of
Warranties |
|
USER expressly agrees that
the use of the SERVICE
is at member’s sole risk. The
SERVICE
is provided on
an “as is” and “as available” basis. TypicalHost expressly disclaims all
warranties of any kind, whether express or implied, including, but not
limited to the implied warranties of merchantability, fitness for a
particular purpose and non-infringement. TypicalHost make no warranty that
the SERVICE will meet
USER’s requirements, that the SERVICE will be
uninterrupted, timely, secure, or error free nor does TypicalHost make any
warranty as to the results that may be obtained from the use of the SERVICE
or as to the accuracy or reliability of any information obtained through the
SERVICE or that defects in the software will be corrected. USER understands
and agrees that any material and/or data downloaded or otherwise obtained
through the use of or from the SERVICE is done at USER’s own discretion and
risk and that USER will be solely responsible for any damage to USER’s
computer system or loss of data that results from the download of such
material and/or data. |

VIII.
Modifications to SERVICE |
|
TypicalHost
reserves the right to
modify or discontinue, temporarily or permanently, the SERVICE with
or without notice to USER. USER agrees that TypicalHost shall not be liable
to USER or any third-party for any modification or discontinuance of the
SERVICE. |

IX. Actions taken by
TypicalHost |
|
TypicalHost USERs
agree to indemnify and hold harmless
TypicalHost from
any claims resulting from the use of our SERVICE that damages them or any other party. The
TypicalHost
SERVICE is provided on an as is, as available basis without
warranties of any kind, either express or implied, including, but not
limited to, warranties of merchantability, fitness for a particular purpose
or non-infringement.
TypicalHost
expressly disclaims any representation or
warranty that the
TypicalHost service will be
error-free, secure or uninterrupted.
TypicalHost
will not be liable for any cost or damage arising either directly or
indirectly from any transaction or use of the SERVICE. |

The failure by a USER to meet or follow any of the above Terms of Service is
grounds for account deactivation.
TypicalHost will be the sole
arbiter as to what constitutes a violation of the Terms of Service.
TypicalHost
reserves the right to remove any
account without prior notice. |
|
TypicalHost reserves the right to suspend the USER's account and services
without notice should there be any problems with the customers method of
payment. |
|
The data transfer options are available on our site. In the event of
over-usage, USERs will incurred a fee of P150.00 per 1GB. |
|
|
X. Notice |
|
Any notice to USER or to the
SERVICE shall be made via e-mail. The SERVICE may also provide notices of
changes to the Terms of Service or other matters by displaying notices to
Users generally on the SERVICE. |
